Maybe I am misinterpreting your post but I think we are in agreement. The comment you were referring to is directed to state resources, not employer resources.

The state does not need to be "protecting" pot smokers at this point in time.
I too want employers to be able to build their businesses and not be burdened with silly regulations.

It's pretty simple - If your employer does not want you smoking pot - DON'T or find another job.

The employer should bear NO additional exposure for the lack of state sense / support.
STATE just needs to issue a regulation:

If you are working under these xxxx job classifications, (based on L&I data / exposures),
1) MANDATORY pre-employment and annual drug testing.
2) No use of drugs / alcohol within 8 hrs of operating equipment.
3) FORCED drug testing on random basis (must be registered with a STATE recognized and licensed consortium) . (I have racked up over $800/ yr in 'Random' drug tests for my CDL).
