Our neighbor (Orange County, FL) hired someone off of Craigslist to cut down a perfectly healthy tree in his yard. It fell on OUR house and is going to cost $2500. What can we do? He isn't willing to pay...

His insurance denied our claim, our deductible is $2500 and the guy from Craigslist isn't returning our call.

Small claims court might be your only option.

It's his tree, he cut it down, it cost damage to your home.

It's his responsibility.

It's a shame he isn't willing to pay.

Thank you for your quick response. Our neighbor's insurance company says it is the guy from Craigslist's fault. Is that true??

I really don't want to sue him or anyone.

You will need to take him to small claims court. His insurance should pay and then subrogate from the tree cutter.

Filing in small claims court is fairly inexpensive and very easy. I would rather sue than be out $2500 of my own money.

You need to take your neighbor to court, it's his responsibility to contact the person he hired, not yours. Either that or accept the loss, but if you bend over, you should at least give him a bottle of lube because he won't learn his lesson and will most likely cause damage again. It's easy to take someone to small claims, we've done it before.
