I moved in April of 2014 and currently out of my lease, so I think by law I am technically month to month since my landlord hasn't asked I sign a new lease. Outside of this issue, I love it here. I like the location and everyone that lives here is really pleasant. I don't want to move. Is there anything I can do about this leak issue? They keep saying the only thing they can do is repair it, water test it and try again. It's like they are going at this blindly. I can't imagine what kind of nastiness is behind the wall.

Are you on the top floor? Is this a leak that occurs after a hard rain, or is it coming from plumbing above you?

It is ridiculous for them to state that this can't be fixed.

I am on 11 and the top floor is 12. The 12th floor has like a exposed roof over their balcony. It is the 101 Eola building downtown if that is any help. Yes mostly from long lengthy rains or harder rain days. So yesterday's rain was when I filmed the most recent leak. It isn't from plumbing, there is something it is getting from something exposed up top. They did a water test where they sprayed water from all directions and finally found where ...but i think yesterday's rain was so bad that it penetrated through the fix.

I would be more worried about the toxic black mold which is probably behind the walls and ceiling than the water itself. Obviously the landlord/HOA isn't willing to take the steps needed to actually fix it. Time to move. It needs to be someone else's problem. It's not worth your health.

If you didn't renew the lease you are month-to-month and can leave with 30 days notice.

Definitely looking to move, probably to another unit in the building. Even if I was in a lease, I think the leak is enough reason for them to let me out of the lease. The hoa is going to have someone come detect for mold though... let's see what they say.

101 Eola is not a property managed building, it is all privately owned condos, so you must be renting from a private owner. Are you talking directly to the Condo Association or are you going through the condo owner you are leasing it from? That is completely ridiculous to have that issue there with the COA fees they charge. It's over $500 a month just for the COA fees for a 2 bedroom there.

That ceiling looks like it won't be long before it falls in.

Just be sure you have printed dated evidence of your requests to the landlord to have it fixed so that you can't be blamed for not reporting it when it's found there's a pipe between your unit and the upstairs one that has broken and is also causing mold under the upstairs unit....if not in it.

Have you talked to the people above you?

Yes, I am renting from a private owner. Including both the owner and the property manager in all communications. It is managed by a property management company, just not in the same way like Aspire is. www.condominiumconcepts.com is who manages this building.I agree, super ridiculous to have to deal with this and paying what I pay -- although it is a little cheaper than some of the apartment buildings downtown or right outside of downtown. Probably a bit of a benefit of renting from an owner vs a property company. I don't have to pay the hoa fee's but yes you are right they are up there.
