Capital One does have pretty bad customer service. I've dealt with them in the past on different issues. As Karla says, write to higher-ups and send everything with return receipts so they can't claim they haven't received it.
I worked for a Division of Taxation in the call center, and believe me there were times when payments "disappeared." We had to refer them to the higher ups who dealt with the bank in question. Someone's not doing their job.

Well, hopefully once they send out her statements, we can state which are legally hers and which were unauthorized, fax that over with the 2 letters from Cap1 stating payment was sent from her BofA account.
