The debt isn't secured to anything. Why file?

Bankruptcy is a waist of time and money for most folks. The CC debt , will go away after 3 to 5 years , maybe sooner , depending on whats left in the bag of tricks held by the present Administration. At lest , hold off until you get a judgment against your personal credit. Find a local banker to work with , separate your past life with a new policy of doing cash deals, and , don't spend your last dollar , tiring to hold up any credit score you have left......... many good deals will come your way , when you pay in cash. Build equity in appreciating value things , forget about a new car or truck.....for a few years.

Are you advocating the OP to talk with a bankruptcy attorney about stopping the calls or to actually file?

Once you file , all calls should be forwarded to your attorney. Once you tell the collection person on the phone you have filed BK they will ask for the ph. of your attorney. In many cases , the collection people will just write off your account , or , it will be forwarded to their legal department..... from that point on , all calls will stop. It is illegal to harass a person once he or she has filed. As well , file BK or not , it is also illegal to call you at a place of business. Only your home phone is on limits to the collectors.
Again , not everyone with a lot of debt should file BK. The laws have changed , are changing now also , so depending on your state of residence , contact a knowledgeable attorney in your state that specializes in Bankruptcy. Often , the attorney will know all the court appointed apprizers that would apply to your case , and , can give you a heads up as to how your case will precede. The first think the attorney will tell you , is to cut up all the credit cards. The second thing is have a cash reserve. be able to survive at lest 6 months on income from a job , and or savings. remember , He wants to be paid also !

Sorry to hear of your struggles.

How much equity do you have in your home? Can you sell and clear out all debts?

People are responsible for taking on debt yes. Just as the banks are responsible for giving unreasonable terms. Allowing people to take on far more debt than they could ever pay back and then for putting on ridiculous fees on top of payments when people are already having a hard time paying. That is what you called a bad business model. Same way the consumer reaped what he sewed, so did those silly banks. So bankruptcy for all.

Yes, accountability goes all the way around. I don't feel sorry for banks that failed due to the choices that they made any more than I pity the consumers who bought $750k homes on $30k/yr incomes. I just don't want to hear any of them whine about how their current problems are someone else's fault.

Maybe you could get a job on the weekends or nights so you could still watch the kids during the day and still work enough to make 1800 a month. And maybe you could find another family in a similar situation and you could watch their kids a couple days a week and they could watch your kids a couple days a week while you work.
