So there are these 3 handicapped spots on a street in Oakland that are close to a house I rent out and, like almost all other handicapped spaces in Oakland, haven't been occupied by a bonafide handicap-marked car in years, and it's a pain for me, my tenants, the other landlords, & the families that live here. Is there a way I can petition or request the city that the space be removed?

I am sure it is possible but there may be some sort of city ordinance that is in compliance with the ADA that for the number of parking spots, there should be X number of handicapped spots. The little research I just did shows that there are no state laws about handicapped spots being required but it is left up to each city, town, borough, etc., what they want to do and how they will enforce it. If they go against a "suggestion" by the ADA, it may leave them open for lawsuit which they may not want to do. Someone on here probably has more knowledge of the specifics but that's my take on it.

It's worth asking. Those spots might have been for former residents. My childhood neighborhood still has a "Beware of Deaf Child" sign. After 40 years, I doubt there is still a deaf child in the neighborhood.

The house across the street has a handicapped spot in front and the owner passed away a couple of years ago. Someone is currently rehabbing the house and I wonder if they'll get that spot removed before they try to sell it. I'll ask them about it next time I'm walking by.
