The man who burned a Koran this past weekend at the protest of the proposed Islamic community center and mosque has been fired from his job. Derek Fenton was terminated from his NJTransit job on Monday after pictures of him "Mapplethorping the Quran" were published in newspapers all over the country. That would be correct. The ACLU usually only protects the freedom/religion of speech to those who want to destroy this country. They will likely take the side of anyone who might want to sue this man for exercising his rights instead.
I think this does present an interesting legal question. How far into a person's private life can an employer's reach extend? Is there a difference if the employee is a state employee or not? Is an employee essentially 'always on the clock' when it comes to their private life?
