Yes, and even if these children were in danger of actual abuse, by putting that in there the state just lost their case.
Lets see, they had both of their other children removed because of abuse and neglect and now their newborn is being taken away too. Makes sence to me. Maybe if the mother realised how bad things are between her and her soon to be ex. then she could get her children back.
