Kudos to Ruth Bader Ginsburg for being the only member of the court with the "balls" to stand up to the slowly-creeping fascism that is taking over a once-great country.

So if I just took a dump and flush the toilet as the officers knock they can break my door in. Great.

This ranks right up there with the Kelo v New London case as an example of berobed tyranny.

In the end like pursue they still have to prove proable cause.There are many exceptions to search warrnats already much like this.

We have more 4th Amendment protections today than ever before in US history (thanks to groups like the ACLU).

She is standing up to authoritarianism, not to fascism. I agree, kudos to her and her philosophy of the law.

Why not eliminate the 4th Amendment? That would make things much easier. It just gets in the way of law enforcement.

I'm glad we agree on the integrity of her opinion.

As for the term "fascism", it is, of course, a form of authoritarianism. However, there is significant disagreement as to its broader definition. The term is often used in reference to a political entity which exhibits, among others, the following tendencies:

*A concentration of centralized political authority which subjugates individual liberties.

*A heavy utilization of military power to support national industrial and commercial interests.

*The use of law enforcement personnel to quell political dissent.

I used the term "fascist" because I am of the opinion that our nation has been moving in that direction for decades, and because I believe this decision to be one which enables the government in pursuing that level of control.

Disagree with my assessment if you want to, but don't come at me with illegitimate semantic statements.

The only dissenting justice was Ruth Bader Ginsburg. All other eight justices endorsed the other side, and the majority opinion itself was written by Samuel Alito. It's interesting how the court has been gradually narrowing the scope of the 4th Amendment over the years.
The Indiana Supreme Court Justices would be proud.
