Is the police state really already here?

I suspect that is not too far down the road. A chip with medical info. for Obamacare and for all financial transactions just like is the new mode of payment via smart phones now. No one will be allowed to participate in trade, receive pay, pay taxes or recieve medical care without one. Digital "currency" will be what is used after the US dollar is crashed and removed as the world currency.

Back to the black boxes. What gives them the right to do this to private property?

Not much to do with Obama. Nearly all vehicles (including - in all probablity - YOURS) ALREADY have them.

"Many major automakers already include them all vehicles, including General Motors Co., Ford Motor Co., Toyota Motor Corp. and Mazda Motor Co.

The devices have been in use for about 20 years.

GM began widely installing the predecessor version of today's event data recorders in vehicles in the 1990 model year, and they became standard equipment in light duty vehicles in the 1995 model year

I actually asked about that when I purchased my last new vehicle. I was aware that they were placing them in rental cars and there was a big issue locally about them and the manufacturer/dealer being required to make that disclosure at the time of purchas. I was told no that it was not being done; however my manufacturer is on the list in the article (not GM). So, where would I find this black box if it is there? Is it up in the dash where I cannot see it or in with the engine, or, somwhere else?

Just because these devices have been for 20 years doesn't mean Obama had nothing to do with it. His master Communist Muslim plan was hatched decades ago, beginning with his birth announcement in newspapers.

Actually it goes back further than that - as recently translated hieroglyphics stating "Yes We Can" attest.
