He could be appealing the first judges decision that they don't jurisdiction. (He will lose)
OR
He could pull his head out of his rectum and file a NEW suit at the federal level.
I personally believe that either:
a) Jesse and his legal adviser are nuts.
OR
b) Jesse and his legal adviser know full well their suit would be struck down but it's cheap and easy to file such a suit, have it obviously thrown out and then rail about the unfairness of the govt. not even listening to your suit.
He's getting donations, selling books and driving traffic to his website without having to bear the expense of a REAL federal challenge. Laughing all the way to the bank probably.

So what's the Court of Appeals have to do with it?
Jesse can't get his whopper at McDonalds....so he can go over and appeal the lack of whopper at Taco Bell but they will just tell him the same thing.
"Mr Ventura, you were a dummie to try to buy a Whopper at McDonalds, BK is right over there sir."
Then Jesse can walk down the block and go to BK where they will take his order for a whopper.
Meanwhile he and his minions scream conspiracy that he was denied a Whopper at McDonalds....and he gets more traffic to his website, maybe a new TV show and whatnot. Jesse is crazy like a fox.
Seriously google it, he is all over CNN etc. great publicity for a faux suit that cost him almost nothing.
