For those still fantasizing that this Marine was going to magically avoid appropriate punishment, it looks like we're approaching the end game.

For a third time, a federal judge Friday refused to halt the U.S. Marine Corps' process of discharging a sergeant who posted critical comments about President Obama on Facebook.

District Judge Marilyn Huff refused a request from civilian attorneys for Sgt. Gary Stein to halt the dismissal. The attorneys said they will appeal to the 9th Circuit Court.

An Administrative Separation Board at Camp Pendleton last week voted 3-0 to recommend that Stein should be dismissed and given an other-than-honorable discharge for making comments "prejudicial to good order and discipline."

The decision will be made by the commanding general of the Marine Corps Recruit Depot San Diego.

(U.S. District Judge Marilyn) Huff disagreed, calling Stein's postings "truly troubling." Service members have had their speech limited since the Civil War, especially if their comments are believed to disrupt good order and discipline.

The judge pointed out Stein's March 1 comments on a Facebook page used by Marine Corps meteorologists in which the sergeant stated, "Screw Obama and I will not follow all orders from him."

yeah right, a coward for exercising his 1st amendment rights. goes to show that alot of people on both sides of the politicial aisle still believe that the 1st amendment only applies to them.

also, an other than honorable can be upgraded every couple of years. the only one that cannot is dishonorable, only a potus pardon can make that go away.

i dont consider fb public, after all you can limit who sees your page.

Clearly this person was not smart enough to limit who could see his page, because the wrong person saw it.

Fair. I know that as much as my boss might have issues with upper management, if I voiced them on Facebook and she saw, she would make sure I was fired because it makes EVERYONE look bad.

You give up your right to "free speech" when you take that oath. We all did. And should. Do your job, and do it like you're told. People die less that way. You don't need free thinkers - after a point - in the military. You need someone who will do their dang job. I'm sorry if he was so stupid he thought the rules didn't apply to him. Guess what.... they totally applied to him.

Sieg, you obviously have never served in the military. If you did you would know that what he said has nothing to do with free speech and the judge isn’t a liberal scum judge for doing what he did. You can continue to live in a dream world if you like where black commander and chiefs don’t have to be respected and obeyed or you can come into the real world and accept reality.
