It depends. All states cannot discriminate against race, creed, religion, national origin, etc., but I don't think Title IX has been amended to include sexual orientation. Unless NM or that locality has implemented a law saying it can't. If it hasn't, then this is called judicial activism

New Mexico has passed an anti discrimination law which includes sexual orientation.
