Yes, do remember who's responsible. Environmental standards are set by Congress. All the EPA does is enforce their will. It wouldn't matter who is in the White House, the standards would still be enforced.
Speaker Nancy Pelosi (D-Calif.) said Wednesday that Congress, not the Obama administration, needs to address global warming.
Asked if she wants the Obama administration to address climate change through regulations if Congress fails to pass a bill this year, Pelosi responded, "It has to be done by statute."
Well for starters considering CO2 was not a concern in 1990 do you think those voting for this legislation envisioned it being used to regulate CO2. The only reason they were able to accomplish this is because the definition is broad and didn't specifically exclude greenhouse gases.

The EPA themselves determined they didn't have the authority to enforce greenhouse emissions, the court case was brought by some states and environmental groups. The decision was split on whether the life giving gas CO2 is a pollutant, under these definitions you could argue anything was a pollutant.

Of course it has to be done by statute. You do understand the law, don't you? Nobody, not even a government agency, is above the law.
In the case of the EPA and CO-2? Yes, there is some question whether or not Congress intended to regulate that and the EPA has repeatedly asked Congress for clarification. So far, they have refused to do so, leaving the EPA between the proverbial rock and hard place. They cannot simply refuse to enforce the will of Congress (there's that pesky law thing again), so in the absence of clarity from Congress, they've had no alternative but to interpret the law as they think it should be interpreted, leaving the courts to decide whether they are right or wrong.
