The War Powers Act of 1973 (50 USC 1541-1548) is unconstitutional, which is why no President (Democrat or Republican) has ever used it, until Obama. Article I, Section 8, Clause 11 of the US Constitution grants Congress the power to declare wars. The US Constitution does not give Congress the authority to delegate that power to any other branch of government.
