Since gay marriage is being forced upon the states and even those who do not want it, it is time to consider that the government ( the states ) get out of it all together.
Marriage should be abolished as a state sanctioned anything.
If someone wants to enter a legal contract to share parental, monetary, and other responsibilities, then sign a contract that lays out the expected actions, and the consequences for breaking the agreement.
But marriage is a religious ceremony. As such, states and the federal government should not be participating in it. Everyone should be taxed on the individual. Living with someone shouldn't penalize or reward you.
I think spousal immigration visas, being allowed to live with your spouse in military base housing, having the right to sue for wrongful death in a court of law should someone negligently or intentionally kill your spouse, your spouse assuming the legal right of making emergency medical decisions on your behalf, your spouse automatically inheriting if you die without a will, etc., etc., etc. are all good things, so no, I don't think states should get out of the marriage business.
so can any legal contract drawn up by an attorney.
A contract can't create many of the legal rights provided by a civil marriage (see post #7 for several examples). Those are legal rights only a government can confer.
Marriage is only religious if you are religious. My parents have been married for over 30 years and religion never played ANY role in that marriage.
As a single person who subsidizes state marriages, I don't care either way AS LONG AS GAY MARRIAGES ARE TREATED EQUALLY. But don't make it into a religious thing - that's between you and your place of worship.
