We have castle doctrine here as well and there's no duty to retreat inside the home. The law states that to use deadly force you must be in imminent threat of serious bodily injury or death. I don't see how someone attempting to climb through a window meets that criteria.

I have a brother in jail, who committed three violent felonies. I hope he stays in there for a long time because as long as he's in there, our society is protected. If he gets out and gets shot as he commits a crime, of course I won't be happy, but I would certainly say that he brought it on himself.

I certainly wouldn't blame the victims of his crime.

The laws here are different. In Texas it's a good kill. In other states it might not be, but that's not relevant to the discussion here IMHO.

Personally, I would probably shoot someone climbing through my window. Why wait for them to get all the way inside the house? They're not there for milk and cookies.

You can in Texas. Joe Horn did just that. So did someone defending their SUV parked in front of their house. No charges on either of them.

Of course they should not be happy, despite thier child being a career criminal and a pox on society. They are still his parents.

However, they should-

1. remain silent and greive

2. not say stupid things to justify thier son's criminal behavior

3. have been better parents and tought thier son not to be a criminal

4. have taught thier son responsible behavior

5. taught thier son that there are consequences to behavior


Another dead criminal. The family will greive, but society celebrates. Now what would have happened had the guy killed the old man? Would that have even made the news? The "good child" would have eventually been killed in another mishap; the only difference is that more innocent people would have been harmed.
