PBS - yeah those commies - air a program suggesting that H1B visas for high tech companies is nothing more than a scam to replace American high tech workers with foreigners who in effect become indentured labores for the company that sponsored their visa request?

What do you think?

The Left historically has been lukewarm at best towards immigration. Hard to organize against evil capitalist when more workers keep pouring in.

Around the 60s that changed. The thinking was that immigration was ok as long as it was non white. Black liberals thought these new migrants would be new allies against Whites and White liberals were willing to risk weaker labor movements for votes.

So PBS being against H1B doesn't mean they're not hopelessly liberal.

There is a need for professionals with rare skills especially in IT. The collages teach skills which are in high demand, but they do not teach people to maintain old applications which were developed with older software tools like RPG and COBOL.

Corporate scam, I think. If there is, indeed, a lack of talent for certain skills in the US, then it's the fault of universities for not promoting the STEM programs, but instead tacidly encouraging idiot students for taking degrees in basket weaving or potty training. H1B visas are primarily used by industries to increase the supply of labor of a certain field to lower wages/salaries, especially if they aggressively recruit people from developing nations, such as India. An equally talented European worker would not accept the job without a decent benefits package and pay, the Indian would most likely think any benefits package and pay is much better than what they have now

When it comes to highly skilled and experienced staff you can never get enough.

For example, when Congress passed the Sarbanes-Oxley Act, we did not have enough auditors to do the work that the Act and the PCAOB (which was created by the Act) required. And, as it takes three years to train a kid out of college before they can do the work, we did not have the time to grow our own. We recruited who we could in the US jobs market - and many of them proved to be substandard and were let go subsequently - but we were forced to look overseas for people with the requisite skills and experience.

That's a bit of a myth. The H1B workers I have been associated with have received the going rate (which is actually dictated by law).

That's all fine and good as anecdotal information goes but...

What H1B employee is going to initiate a discrimination suit when the company effectively controls their visa?

Was Sen Dick Durbin making this up or just lying when he stated:

"Our bill would require that before an employer may hire an H -1B worker, the employer must first advertise the job opening to American workers for 30 days on the Department of Labor Web site."
"Some companies that abuse the H -1B visa program are so brazen, they say “no Americans need apply” in their job advertisements. Hundreds of such ads have been posted on line. They say things such as “H -1B visa holders only” or “we require candidates for H -1B from India.” Is that what we have in mind, to create this perverse discrimination against American workers?"

"The legislation we have introduced would overhaul the H -1B program, protecting American workers first, and stopping H -1Bs from being exploited as outsourcing visas."

They don't have to initiate a lawsuit, they just have to send an email to HR. As a matter of fact unless the HR is in the scam, they would stop the scam during the hiring process. HRs can be audited, and larger companies are NOT willing to intentionally break the law, and it is mostly larger companies who hire H1B workers.

Maybe US corporations are not at corrupt as you think. I have been working with H1B workers for 20 years and I have not seen what you claim is happening. It doesn't mean no one has ever been screwed, but at least is it not as widespread as people think.

Corporate scam....

Computer programming salaries have been flat for the last 20 years as demand has grown.

The biggest thing is companies do not actively recruit an American for the position and pay a below market wage for it. I have seen it as I work in IT. You need a oracle database or SQL programmer, but can only afford 35k a year for salary, you get a H1B visa guy. The average salary for this position would be over 80k a year... Here is a company actively advertising for H1B visas...

Not even following the rules and trying to find an American equivalent.
