I think there are going to be outraged liberals and members of the media in a few months. They will find their incessant cheerleading for this deviency beaten back by one they least suspect, Sotomayor.

I don't know, maybe the things he's said in court about gays over the years:

This is a likely outcome. Although I could also see Prop 8 being upheld.

If one needs a marriage license, it is not a right, secured by constitutional government.
It is a privilege granted by government.

However, those who hold common law standing can contract a common law marriage.

Guess what changed so that "everyone" must get permission to contract marriage?
There is a right to marriage. What gays want is to do redefine marriage. However society has every right to determine what marriage means to them and as the justices alluded to today we are talking about 5 years of data vs 2000 years if traditional marriage and that's just in Christendom.

DOMA and Prop 8 are upheld IMHO although Prop 8 being invalidated wouldn't shock me.

It descriminates based on your marital status. This is why the ideal of individualism leads to the most liberty and most rights for all Americans.

From what I'm hearing, the justices are highly skeptical of the Prop 8 proponents' claim to standing, which is why there's a good chance that the Ninth Circuit ruling will be allowed to stand.
