You realize it would have been against the law for him to divulge specifics on Intelligence matters in open hearings. His answer could been to suggest closed committee hearing on specifics.

That's the duplicity of the whole situation. The point being, he shouldn't have lied.

If so, his answer should have been along the lines of "that has to do with National Security and I cannot answer"

at the same time i don't want to see him used as a scapegoat, as this whole NSA debacle is the fault of congress, and prosecuting him will solve nothing.

An example has to be set that you don't lie to Congress and get away with it.
In my extremely humble opinion, if James Clapper isn't prosecuted it would mean that the rule of law no longer means anything in the U.S. and that is utter chaos.

i felt that way about the financial firms in '08
and yet the country continues to operate
the patriot act authorized a lot of this stuff, and i can clearly remember a lot of older people defending it, on the basis of national defense. Where are all those people now?
