Yes. If empiricism is what we hold as the "holy grail" of the scientific method, then don't we have every right to reject any explanation of what we observe without it?
I don't understand what you're saying. Again, there are other methods of detection without actual pictures in the visible spectrum. I'm not sure why or if that's an issue.

If you would just answer the following questions, then we can engage in a discussion concerning the validity of ToE as a scientific theory.
Why do you believe that there is observable evidence for evolution?
A scientific theory requires observable evidence, must be subject to repeated testing, and must be falsifiable.
Evolution meets none of these criteria.
