Criminals take upon themselves all the consequences of their victim's damaging actions in defense of person and property.
For if they had not trespassed, there would have been no cause.

Even if retreating, the victim cannot be sure that they won't circle around and attack again. Unless, of course, the law is no longer for the protection of victims, but a guarantor of the rights of the predators to prey upon us.

Police officers would have fired multiple times, even with several firing in unison, to bring down a criminal they deemed a threat. That mitigates any possibility the homeowner could be charged with using excessive force or unnecessary lethal force. The DA would likely be throwing his job away if he tried to make a case against the man.

THIS "Liberal" thinks the burglar got what she deserved, her accomplice should be charged with her death NOT the old man.

You break into someone's property it can be presumed you mean harm to anyone you may come into contact with ... That person can defend themselves in any manner they feel necessary.

whether she was pregnant or not is really irrelevant. I doubt that even CA law speaks to this. You can't shoot a fleeing thief in the back, even if she just broke your collarbone. If he had fired while being attacked he would be free and clear, but he fired as she was fleeing, according to his own account.
