So it would seem a state law would trump a county charter and there does seem an ideological basis for the sheriffs non enforcement. Maybe not, but I find it hard to believe that this law would take personnel from other tasks, especially since law enforcement in Oregan doesn't have to worry about marijuana enforcement.
And Federal law trumps ideology so why was Holder allowed to resign instead of being charged criminally? Why is that idiot still allowed to infest the WH because he ignored black letter law that he doesn't agree with?
I suppose that's one factor that often gets overlooked in the great gun debate. What if local law enforcement simply refuses to enforce the laws? This particular sheriff has a lot of like-minded company around the US.
Sheriff's are elected. They do take an oath to uphold the US Constitution and the State Constitution.
If it steps on the Second Amendment, they are suppose to follow the Constitution of the state, not some statutory law.
I would imagine not enforcing a law would be a reason to be fired, sheriffs aren't above the law despite being locally elected.
Nope, LEO's, especially elected sheriffs, have wide discretion in enforcing laws. There's a long history in this country of sheriffs not enforcing bad laws. That's why they were always an elected position.
Even biden said we don't have resources to go after people who lie on backgrounds checks, why pass another law that will not actually do anything?
I know it's a right wing belief that Obama does all these unconstitutional things, but it's simply not true. It's up to the Supreme Court to decide that and there's a reason why no one has actually tried to impeach Obama.
