How is it the judge and special appeals judge are both black? Shouldn't there be a Judge Ito in the mix or are they representative of the entire county? It gets to be a bit ridiculous.
Wow. I can't imagine this guy will be on the bench much longer. The process of picking a jury is not "picking" a jury, it's "unpicking" a jury--eliminating members of the jury pool for various reasons. You don't have unlimited challenges to jurors. You are entitled to a trial before a jury of your peers, not a jury of people of your same race.
The jury pool consists of people with driver's licenses. If you are summoned and fail to show, there are consequences. Potential jurors who showed up for jury duty are selected randomly to go to the various courtrooms where they are seated methodically, not randomly.
They are asked questions and ultimately eliminated for various reasons. The required number of those still seated become the jurors.
I can see him becoming more active in encouraging blacks to show up for jury duty. Nothing in the world wrong with that. Somewhere along the line, though, this judge became unhinged and has abandoned his judicial oath.
He did the right thing! Juries should be made up of your peers..
Agreed. Turn the tables. White man accused of rape, or murder of a minority. No way in hell would that white guy want a jury composed of all minorities.
A peer should be someone of similar background, race, religion, etc.
How should the jury administrator go about ensuring that only korean, middle-class, presbyterian, conservatives with a background of isolation and being bullied, living in trailers on rural property, raising pit dogs and fighting ***** for a living with a predilection for animal and snuff porn are on my jury?
If they cannot, it would seem I am being denied my right to a fair trial due to the lack of peers for my jury. I guess I can do whatever I want without fear of prosecution!!
I am not aware of any official source for this data to ensure only my peers are selected. Guess they have to google everyone before sending out the jury summons, huh?
Perhaps the reason there are never enough black people on juries is because not enough of them have drivers' licenses or are registered to vote. Just a thought.
Highly doubt that. It is a silly thought. A majority of black Americans have a driver's license who are able to drive and black people are registered to vote in pretty large numbers, especially in metros with a large black population like Louisville. In the article (it seems like many of you didn't read it) it was stated that there were black people available to be chosen but none were chosen for one reason or another.

IMO that is up to the courts at this point to decide. I know how the jury selection process works whereas the lawyers choose the jurors from a pool of summoned persons. The jury selection process is complete random.
Who gets summonsed is random.
Who gets called in is random.
The order they are called up to the courtroom is random.
The order they are called in the courtroom for selection is random.
The only thing that would cause an under representation of blacks is 1. The higher felony conviction rate, but this is still a small percent of the overall population so the affect would be negligible and 2. A higher failure to appear rate when summonsed.
So really it boils down to blacks not showing up for jury duty to the same extent as whites and participating in the justice process. In other words, the bias you think is present in this case is being created by blacks by not showing up when summonsed.
And the decisions of the lawyers, both prosecutor and defense, should just be ignored? They are the ones selecting the jury, not the judge.

You opinion is of no concern. The judge does not decide on the jury which you admit but still try to claim as true.
good... sounds reasonable and I'm sure it's done when there are too many women or too many minorities in a jury.
