Because its not about state's rights. Its about rolling back rights on the LGBT community. Please note Trump's plans/ideas re: marijuana legalization.

Rolling back what supposed "rights?"

Two things:

1) Federal level: There are no Federal Rights.

Regarding the case of a F to M transgender who was still anatomically female but was using men's facilities on campus

Quote:
"Federal Judge Kim R. Gibson dismissed Johnston's suit, saying that his transgender status was not covered by either the Constitution's equal-protection clause or Title IX of the Education Amendments of 1972, which bars sex discrimination by institutions receiving federal funds.

With regard to the equal-protection clause, Gibson writes that transgender status is not a "suspect class" under equal-protection review, so that Pitt can prevail as long as it shows a "rational basis" for its actions. The university "explained that its policy is based on the need to ensure the privacy of its students to disrobe and shower outside of the presence of members of the opposite sex. This justification has been repeatedly upheld by courts," Gibson writes."

2) State level:

So you would have someone half way or more through the transition and who no longer looks like their birth gender still use the room of their birth gender just because they haven't had the surgery yet? Asinine
I empathize with the plight of transgenders and know it is not an easy road for them. I also understand that the transgender transformation is a lengthy process and that during it they are betwixt and between not really fitting in with the male or female world. During that period they need to be sensitive to others and use unisex facilities rather than the male or female locker rooms. I don't care about the bathrooms as nobody sees anything. Locker rooms is the issue.

Perhaps you don't have kids or your kids were raised as nudists. When my daughter was in middle school my wife found her a female pediatrician because she was no longer comfortable with the male pediatrician she had since birth seeing her not fully clothed. That is more the norm than not. Why in the world would you demand that she'd of been comfortable in locker rooms with people that were not anatomically female when girls her age aren't even comfortable with a male doctor seeing them?

I would add that my son stayed with the male pediatrician but for a physical in middle school was mortified that a female nurse was present for his genital check. Again, that kind of reaction is more the norm than not.

Kids should not be forced to have opposite gender exposure before they are ready. It can't just be demanded of them. Maybe we'd all be better off if kids were raised to be comfortable with nudity, both same sex and opposite sex, but that is far from the norm in our society. If anything we're still moving in the opposite direction vs the way it was back prior to about 1970.

It is not asinine for kids to be shy.

Once the clothes are off, nobody sees anyone's feelings nor is there the facade that clothes can create.

Most transgenders are not looking to draw attention to themselves, but one has to question why they insist on being present while biologically opposite gender kids are changing & showering.
If the "real issue" is locker rooms, then please post some facts/figures relating to how often this problem has cropped up. Because there haven't been any reports of a rash of locker room incidents either before or after NC panicking and coming up with this dumb legislation.

Even more amusing is how the GOP has glommed onto it and tried to make bathroom bills one of their leading agenda items.

It is extremely unlikely that a transgender is going to misbehave in a locker room. Their life is tough enough without adding discipline issues onto it too. The issue is the discomfort of the other kids. Why is that concept so hard to understand? Do you have kids? Would you tell your 12 year old daughter to just deal with it and not be shy?
