Battle #1 was the Earned Income Credit (EIC) which was being used by illegals who were claiming children that lived in Mexico and were getting over $5000 refunds every year. That battle was recently won by the IRS (or whoever was pushing it, I don't recall) and they changed the rule so that people claiming the credit had to actually verify that the children lived in the United States.
There is no requirement that anyone filing taxes be any kind of legal resident. The requirement is that anyone who makes money in the U.S. owes taxes here, so yes, illegals working here illegally are required to file. Sports and entertainment people who only come here for a game/performance have to pay also.
