3. Your post is weird.
You nailed it.

Okay, let's change it up: You are in the produce department of the grocery store and a man is dressed like a woman, WOULD you ask him if he were a man or a woman?

If you wouldn't ask a stranger, then you have your answer.

What if they are transgender?

Let's say I said to him or her, "excuse me but I have a question. I like you and I appreciate all the hard work, lots of it quite dangerous, that you're doing for our county and I applaud you for it. But I have an odd question but I don't wish to ask you if it will make you angry , hurt or uncomfortable . Do you want me to ask you ? Or do you want to just let me go? "
He or she might say, "no; that's fine . Go ahead and ask me." So I would say, "alright, then. I apologize if you take this wrong but are you a male or female?"
What do you think would happen to me, if anything?
if they arrest you then it is an abuse of power, and could get the officer in question in trouble, not to mention that you would have grounds for a false arrest lawsuit.

so no it wouldnt get you arrested.

In California probably a fine and a criminal record. In the normal, sane, rest of America - nothing.

You'll know the answer if the cop pulls out their weapon.

Make sure you are wearing a body cam with audio and it is running.

You can tell a cop anything even cuss them up one side and down the other. It is your first amendment right.

As long as you don't threaten them, you can call them every derogatory name in the book.

Seriously who cares?

If you are pulled over by the cops deal with the issue at hand. Why do you care what the gender of the cop is?

If you are looking for trouble I am sure you will find it.

Why would it even enter your mind to ask this question. I find it very bizarre.

You are a bad influence. You're going to get my ass kicked one of these days. I'm quite capable of getting myself in trouble without you tempting me in this way.
