I think this is a fantastic idea. By taking this case to court, we will be able to dig in and find out what's really going on.
It's incomprehensible that there are multiple sources who claim the Russians didn't hack & deliver the DNC emails, that it was a disgruntled DNC insider to smuggled them out and delivered them to Wikileaks. The fact that no one in law enforcement, not the DC Metro Police, not the FBI, not the Mueller team, no one, has even spoken to any of the people claiming to have information about this unsolved murder.
It's also strange how the Rich family was so vocal, claiming this wasn't a robbery, that they believed it was something else, were making Youtube videos thanking the online community for helping them search for the truth, etc. Then Brad Bauman the DNC communications guy showed up at the house unsolicited and literally the next day they wanted any investigation halted.
With the court case, now all the evidence will come to light.

I hope they win a fortune. Perhaps Fox will start being more responsible going forward.
The family isn't funding the lawsuit.... Guess who is???
Any Judge will dismiss this, or face slapback suits. I can investigate anything I wish. Even Seth Rich's Murder, without his parents approval.

Did you miss the part where the FBI said that the "...“federal investigator” and “FBI report” referenced in the story as sources did not exist."?
Things that may come to light is subpoenaing Spicer and Trump to testify for their parts in the story. But back to reality, this may be a simple defamation lawsuit, where all the family has to prove is that Fox News published a story that was not true. If Fox and the reporters can prove the story true, they have nothing to worry about. But since the story was retracted and nothing new has been reported, it does not seem likely that they'll be able to prove the story is not false. Funny, in a way the burden of proof will shift from the plaintiffs to the defendants for Fox to be able to prevail.

Burden of proof always is on the plaintiffs, it is up to them to prove that Fox aired an untrue story, not the other way around (no matter how much you wish that was true)
