You do know that universal rights exist that are not enumerated in the constitution? Things like being able to vote, and the right to travel freely. Those come down from English common law and were considered so ubiquitous as to not be needing to be enumerated. Why are we allowed to charge money for a passport or a drivers license?
Don't bring in your legal smarty-pants facts. The idea that the US Constitution didn't erase everything and anything that came before is far too complex.

As far as I know, having a passport or a driver's license is not under the Constitution. They might have been under the Articles of Confederation but that has been long bypassed.

Because SCOTUS has found that the 9th amendment means you have the right to free travel and yet still allows for state regulations of and fee schedule associated with the license needed to travel between states even on federal owned roads. Crazy I know.

You referred to other states doing such restrictions and I responded with the 10th amendment which is, as I understand it, "those items not referred to the US Constitution are the powers of the states.".
The ripeness doctrine comes into effect when things occur outside the realm of the states that they are so major that it is time for the USSC to step in.

Again, the PROMISE program is what motivated the school to not have him arrested....they got MONEY from Obama for looking the other way! The police were complicit in this as well!
