The Trump administration asked a federal judge on Thursday to alter a decades old order that restricted the government from holding illegal immigrant children for more than 20 days, even if their parents are incarcerated and there is nobody to take them. Since "catch and release" is not an option (why even bother to catch them in this case - which is what the Democrats want - open borders), this judicial order effectively requires the separation of children from parents.
The Obama administration asked for a relaxation of this order in 2015 from the same judge, Dolly Gee (appointed by Obama), who the Trump Administration has filed this request with. Details on the Trump filing are included in the article below.
The Thursdayfiling said that a 2015 ruling from Gee, holding that the consent decree covered children entering the U.S. with a family member, effectively made it impossible to detain immigrant families and led to a surge in migrants crossing the border with children.
“These realities have precipitated a destabilizing migratory crisis: tens of thousands of families are embarking on the dangerous journey to the United States, often through smuggling arrangements, and then crossing the border illegally in violation of our federal criminal law,” the Justice Department lawyers wrote. “This entire journey and ultimate crossing puts children and families at risk, and violates criminal laws enacted by Congress to protect the border. Those illegal crossings must stop.”
The government lawyers noted that three years ago, under the Obama administration, the Justice Department asked Gee to modify the consent decree and that she declined. “Several material changes in circumstances” justify her doing so now, the federal government attorneys said.
“Undeniably the limitation on the option of detaining families together and the marked increase of families illegally crossing the border are linked,” the Justice Department filing said. “This Court … has the authority and responsibility to resolve these growing concerns by immediately permitting family detention.”

Of course Congressional Democrats and their propaganda pushing, fake news agents in the media have been insisting that Trump was lying when he insisted that he could not resolve this by executive order. If this judge rules against him, as is expected, then that will prove that it was not Trump who was lying, but rather the liars were all of the Democrats and the fake news media whores who insisted he had the authority to do this on his own.
If Judge Gee (appointed by Obama) overturns Trump's Executive Order, she will have proved him right and will be taking ownership of this scandalous arrangement on herself and on the Democrat left, who is also refusing to allow this problem to be fixed through legislation - as that would run contrary to the illegal open borders arrangement that they lust after.
The pressure is now on Judge Gee (appointed by Obama). If she overturns Trump's Executive Order, the Democrats own this.

Catch and release is not on the table, so it is either lock the kids up with their parents, or seperate the kids from their parents. In fact, if you are just going to release the people that you catch, then what is the point in catching them at all?
But of course THAT is what the Democrats really want. However they are just fundamentally too dishonest to say so to the American people.
President Trump has just signed an Executive Order requiring the kids to be kept together with their parents. They are also making provisions for 20,000 beds at certain military bases in order to accomodate these arrangements. In order to allow this to proceed, Federal Distrct Judge Gee (appointed by Barack Obama) must agree to allow the "Flores Agreement" to be modified to allow the children to be held with their parents for more than 20 days.
If she denies this request, she will have effectively overturned Trump's Executive Order requiring that the kids not be separated from the parents, which will then require - by Judge Gee's order (appointed by Barack Obama) - that the children be separated from their parents after 20 days.
The Democrats and Judge Gee will then own this debacle.
That 20 day period in the Flores Settlement is important - the DOJ is taking it to court, that usually ends up with some sort of extension ...... in the meantime, they are rushing judges to the border to immediately rule on these cases. They will set up Courtrooms in any Federal Agency that can come up with space .... the judges rule - they either stay OR are immediately deported. In the meantime, they are fingerprinted and identified.
They can push a lot of cases through fast ..... and YES, the Democrats don't actually want ANY solutions for those families that sneak in, for the (so called) asylum seekers that don't go through proper channels OR for the DACA kids that the Dems are supposedly fighting for.
ALL of them need to work out that the Democrats care nothing about their welfare - they are Cannon Fodder in their War against President Trump and those who voted for him.

That is not what is happening. And an Obama appointed Democrat left judge appears to be poised to order that these children be separated from their parents.
If she does, then Trump will appeal, with Trump arguing for family unification and the Democrat left arguing in favor of separating the children from their families.
The argument will boil down to the sanity and the legality of a truly open borders policy. This is where the Democrats drop trou and show everyone in America their junk, 90 days before a national election.
Open borders as an immigration policy is truly radical, as are the people who advocate it. The American people do not want that, and calling them names just makes them want to support the name callers even less.
So, let's make immigration and the Democrat's obsession with open borders the central issue of the upcoming 2018 congressional elections. I am good with it. What about you?

The democrats will own nothing because the media will still blame Trump. As far as those 20 days are concerned though, once those 20 days are up, how long do the parents and children have to remain separated before they can be housed together again? Could the facilities just take the kids somewhere for a "fun day" every 20 days and then return the children to their parents after a few hours, and satisfy the requirements?
Trump is definitely the best tactician we've ever had in the Oval Office, always 2 or 3 steps ahead.
