Impeachment and conviction depend on votes. Removal from office is something else entirely. If Congress impeaches and convicts because the "wrong" candidate won, the President has a Constitutional duty to ignore Congress and remain in office. And, yes, that would be some entertaining theatre.

I thought it was obvious without having to state it that 'wrong candidate won' wouldn't be put forth as the 'high crime or misdemeanor', but I guess that wasn't obvious.


My point by pointing out that it is a political exercise, and doesn't proceed as a normal court of law, was that members of Congess could say that, for example, Trump having a hotel in DC (where foreign leaders can stay), is a violation of the emoluments clause. It wouldn't matter if it really is or isn't. All that would matter is that enough members think it is, because all that matters (ultimately, after the processes) re impeaching Trump (the House) and removing him from office (the Senate), is their votes.


If Trump refused to leave The White House, after a conviction in the Senate and enough time to pack up and leave, he would, by some means, be forcibly removed.

my guess in all this has been we'll see something similar to agnew/ford/nixon. pence will step down first for some vague reason ( "more time with family", "creative differences" ), trump will appoint a new VP that was unconnected to the campaign and/or trump. the crap hits the fan, trump resigns and VP X becomes POTUS and gives full blanket pardon for any past or potential crimes to trump and pence.
Impeachment is simply an accusation passed by the house. No one is removed for that. there has to be a trial with a conviction...…..
