Someone breaks into my home. I will not ask why. I will not attempt to ask them to leave. I will not attempt to go after them physically. I have studied several martial arts since I was 18 and can defend myself if need be. I will not take the chance that said intruder is armed and intends to harm me or my family. I will use my 45 acp to stop said intruder in his tracks.
This homeowner was justified.
I think the story is sad and tragic and personally the last thing I would ever want to have to do is shoot someone. But, as I'm sitting here at 1 am in the dark writing this if suddenly someone started to break my door down I would have to take action in an unpleasant way. The reality is you can't sit them down to tea and ask what their intentions are. All I know is my door is being broken down for a reason and calling 911 it would be a minimum of 10 minutes at least in this rural area for a policeman to get here. As I said it's sad, but you are obligated to defend your life.
KOAA.com - Man who killed another will not be prosecuted, "Make my day" law is in play (http://www.koaa.com/aaaa_top_stories/x1971439753/Man-who-killed-another-will-not-be-prosecuted-Make-my-day-law-is-in-play - broken link)
sad, but the shooter certainly had reasonable grounds to fear he was in danger.
But the man was just protecting his family, as any self-respecting person would do. It's not his fault the drunken fool put himself in that situation.
The issue isn't whether in hindsight we can see he was probably harmless. The point is we have rule to deal with broad generalities, and this guy was justified.
