If we could get Congress to declare Al-Qaeda a nation, then, Congress could claim it has no right to exist - Al-Qaeda, that is!
As a nation (with no right to exist), Congress could then declare war on it, and all kidnapped Al-Qaeda enemy combatants could be considered soldiers, and then we could use ordinary procedures to question, convict or kill them.

What you are suggesting will have the exact opposite affect than the one you are fantasizing! If the Congress recognizes some make-believe nation of al Qaeda and then goes on to declare war against it, its combatants become covered by the Geneva Convention! YOU CAN NOT INTERROGATE PRISONERS OF WAR much less convict them or kill them!!!
