We (the physicians) are the ones who bear the brunt of any litigation. However, when we have patients who are refused medicines, imaging, or procedures based on insurance, we make it quite clear to the patient. The patients understand that, in the absence of insurance constraints, we would do what is best for them. It is certainly a bummer when there is a med/procedure/surgery that could help a patient, but is denied by insurance. It is like fighting with one hand tied behind your back.
