TALLAHASSEE, Fla. (AP) - Attorneys general from 13 states sued the federal government Tuesday, claiming the landmark health care overhaul bill is unconstitutional just seven minutes after President Barack Obama signed it into law.
The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.
"The Constitution nowhere authorizes the United States to mandate, either directly or under threat of penalty, that all citizens and legal residents have qualifying health care coverage," the lawsuit says.
This bill IS unconstitutional as it MANDATES healthcare for EVERYONE. Obama and his cronies will most likely use the "Necessary and Proper Clause" by trying to argue that socialized healthcare is necessary for the survival of America. That argument is not valid in my eyes.
I urge those who oppose this new law, who live in states that have not yet joined the suit, to contact their state AG's offices and request legal action be taken to protect the states and the individuals against this over reach of Constitutional powers by the federal government.

That arguement might work if we were simply talking about socialized healthcare. But that's not the issue. I think the real issues are:
(1) Under what authority does the Federal Government have the right to mandate health care for citizens. The tenth amendment to our constitution is pretty clear: All authority not granted to the Federal Government by the Constitution is reserved to the states.
(2)Can the Government (federal or state) force citizens to pay tax simply for the privilege of breathing?
