Can you please tell me what has to be disclosed by a new home builder in Wake County? Do they have to dislose flood hazard zones? What other land disclosures are mandatory? Thank you.

Builders, home owner's, agents are required, by law to disclose "material facts" about the property. those would include things like a flood zone, airport noise (big one in morrisville and parts of cary), pending zoning changes in the neighborhood, street widening issues (in parts of southern wake county the impending 540 connectors are material facts). You should also be given a copy of the restrictive convenants of the neighborhood (if it has them).

A material fact is simply that, it is known, it is documented, it can be seen, etc

Flood zone shouldn't be too difficult to figure out...get some good topographic and soil survey maps and see if there are any streams close to the property. If so, I'd be weary of it!

Although it may not exclusively be on the north carolina real estate commision (ncrec.state.nc.us/) it does have information about disclosures. It is also a great resource for the consumer, and you can call them with questions. They are the "watch dogs" for real estate agents, and are there to protect the consumer. So, check out their site and call them as well.

The information I gave you was directly from the nc real estate brokers manual which is published by the real estate commision
