Hi Guys, looking for a recommendation for a Lemon Law attorney for a vehicle purchased, registered, and insured in NC. Currently located in Apex. My vehicle (2009 Ford Escape XLT) has had a transmission fluid leak with gear slipping since 4,500 miles. It now has approx 25,000 miles - and the transmission fluid leak still exists.

Note various Ford dealerships have attempted to repair this specific issue on this specific vehicle seven (7) times. Our last repair attempt was the "final repair attempt," where notice was served to Ford corporate that this was the final repair attempt per NC Lemon Law and where the BBB facilitated a repair through a corporate flown-in technician. Ford then had the vehicle in repair for 27 consecutive days. Unfortunately the problem still exists as there's a pool of transmission fluid on the floor of my garage.

It's time to consult with an attorney skilled in the NC Lemon Law .. any recommendations? PM me if needed to not violate the forum's TOS

I'm a bit surprised that Ford let you go this far.

I had read several stories of cars that were very clearly candidates for Lemon Law suits, and the manufacturer's rep then offered a deal that was actually better than using the LL.

It was because the LL cars go into a national database and really hurt the manufacturer in bad publicity. So it is to their benefit to make you a deal for a few hundred dollars more than what they'd have to settle with you for.

Also if they do it as a credit good for use in purchasing a new car from them, then they get yet another sale, and maybe even some extra cash from you as you get a next-year model car. That last seems to me to be a win-win (as long as you haven't lost faith in the manufacturer).

So maybe before you cut a check for a lawyer's retainer, give the manufacturer's rep who is handling your case, one last phone call and tell him your done, and will be filing unless he can offer you a better alternative within, say 48 hours.

I handled my own lemon law claim in Illinois. You need to speak to someone in customer service with the manufacturer. If a car is declared a lemon the prior poster is right it is nationally reported in some database and stamped on the title. So, many manufacturers would rather make a deal with you than have that happen. I'd see how far you can get without a lawyer. You might be surprised. I got a brand new car.

Try findlaw.com. It's an attorney locating site and spam free. Never talk to one attorney, always talk to a few before choosing one. If their initial consult costs $$$, or they have no actual courtroom litigation experience with lemons, then move to the next on the list..............

7 repair attempts and they haven't replaced the transmission? Wow. You'd think they'd learn after repair number say 4 or 5.

That's what I was thinking. Pull the trans and install a reman unit. 4-5 hours work.

I had a problem with my brakes and rotors on my Caddy a few years ago. After multiple trips to the dealership, they couldn't fix it. Well, I received a nice settlement after my attorney threaten to take them to court. I kept the truck and couldn't make any more lawsuits for something else as long as I had that same truck. I only had it for7 more months until I could stand it any longer. I just bought another truck.
The attorney I had practices in another state but there are some aggressive attorneys in Charlotte and Winston Salem that deal with theses big car companies every day. My attorney was in Charlotte while I lived in Fayetteville. Interview a few attorneys over the phone and let them know what you want the end result to be to close the frustration you have dealt with from this company.

That's because they'd rather not brand more titles as "Lemons" with them as the manufacturer, so they settled it for less than it would have cost them to keep it on their books as a liability, and you get to sell the car to an unknowing suspect with no "Lemon" title and a soon-to-be upset customer.

That's interesting. I sold it to GM which makes Caddy and the current truck I have now. I would figure they could check it through their GM database before they decide to sell it. I hope they disclosed to the new owners. But we never know with this big companies.

I also dealt successfully without an attorney. I had a VW Jetta, brand new, with a faulty window. It would fall into the door using the power up/down feature. After the 3rd time, I consulted an attorney who told me to write a letter demanding a final repair. I didn't hire the attorney, I did it on my own. After it happened a 4th time, I wrote them again. Much to my surprise, I received a package from them about 2 weeks later offering a settlement. It was a lease that I had had for about 18 months. They offered to take the vehicle back and pay me every single dime I had put into it back. So basically, I had a free car for a year and a half. The whole process was super simple. Once I accepted the settlement, I went the next week to turn in the car at a VW dealer and they had my check waiting there for me.
