QC, I know you already know this but for the benefit of other readers, as of July 1, 2008, all agents are presumed to be transaction agents for residential sales and no disclosure is required.
However, for single agents, Section 475.278(3)(b)1, Florida Statutes, provides that a written single agent relationship disclosure “must be made before, or at the time of, entering into a listing agreement or an agreement for representation or before the showing of property, whichever occurs first.”
Th disclosure does not have to be signed but it must be presented and, if the buyer declines to sign, the agent is wise to note the date, time and location of the presentation on their own copy for the file.
