We listed our home 8 wks ago with a local agent. She has not shown our home 1 time, has made numerous mistakes on the mls listing, one she all but refused to correct. We informed her, after 8 weeks of lousy service, the we wanted to be released from our contract or at least assigned to another agent at the firm. She is refusing to release us and refusing to let us choose another agent. She even said, she didn't care if we went to the broker in charge. Can someone please advise.

Guess I should ad, we are in a desirable location, good school and are purposely priced 15-20K below comparable competition due to sluggish market.

Well, before I will "trash" another agent,
a) she probably will not show your home, that is why we have a MLS. Has your house been shown at all?
b) what are the "mistakes" she made in the MLS? Especially the one she absolutely won't correct?

We have averaged about 2 showings a week, which is good in the current market. The first mistake was listing the sq footage incorrectly, twice. The we lowered the price and removed seller paid closing cost. She lowered the price on mls but didn't remove the seller paid closing cost. She has let our box run out of brochures even though we gave her 2 days notice we were running low, etc, etc. The lastest mistake was listing us on homes.com. We are listed 3 times, which sounds great, more exposure. But each listing is different, with a different price, different incentives, it looks ridiculous. When we ask her to take care of correcting it, she said it wasn't her problem. I had to get the number to customer service myself.

Ok, those are some pretty big mistakes, take them to the broker in charge and tell him/her that you must have these corrections made and he should change your agent immediately or release you from your contract.

I would also tell them it's nice that they are going to pay closing cost out of their side of the commission if an offer is made on that info. Might I also suggest documenting via email all conversations so you have evidence of the changes and requests?

What does the contract say? Was there a seller paid closing cost in there? Was it removed with the price change? and signed by all the parties to the listing contract?
