I have the misfortune of having a sweet gum ball tree just on the other side of my property line and it is dropping hundreds and hundreds of gum balls and my dog is eating them, despite my many efforts.

Question is - the lot is not yet built on and owned by a builder, I called the HOA and told them I want it to be cut down; as it will be cut down when the lot is sold anyway.....does anyone know what my rights are!

I don't know about what rights you have, but your post has me laughing a bit. We had a few sweet gums at our old house and also found the gum balls annoying. Luckily we didn't have a dog eating them, but they were annoying. Now that we are in a different house, I find that I really miss the sweet gums because of their fall color.

Our current yard has a ton of beech trees, which have their own negatives along with some great features (but fall color isn't one of them). I know that if we ever leave this house I'll miss the beech trees with their papery brown dead leaves that hang on until the new leaves appear in the spring and their many surface roots that make it hard to grow anything underneath them.

Send your dog over to my house so that he can eat the hundreds of sweet gum balls in my yard!

We had a sweet gum tree when I was growing up. Those balls were annoying but fun to skate on. Hopefully your doggy will stop eating them once he has to get them out. Ouch!!

Your laws are probably local or possibly state laws. I once heard that (in Florida) a property owner had the right to trim a neighbors tree back to the property line but could not go on the neighbor's property to do it without permission. You might check with your town. Also, if it comes to it, I wouldn't be surprised to see that the owner of the property, once you notified them of the nuisance, could have some liability if something were to happen to your dog. That hopefully won't happen and it would require a talk with an attorney.

The obvious solution is to not leave your dog in the yard to eat them........

Unfortunately, dogs are not capable of making the connection between what they ate and what causes problems on the other end.

Not so sure I'd call that a solution except that it will provide some protection for the dog, certainly. I think a property owner should have the right to enjoy their property without having that right infringed upon. If you don't exercise your rights, your rights get very flabby and weak...

In todays crazy world don't be surprised if you get a nasty letter from the lot owner telling you to stop your dog from eating his crop of Sweet Gum Balls.
