My husband and me is buying a hud owned house. So they accepted our offer on 06/27/2011. And the letter we got from escrow saying the sale will be closed on 07/29/2011. But then when we going to pay, the title company found out seller didn't pay off the lien before they listed the house for sale. And we already applied for 2 extension. It has been 30 days since we applied for the extension, and it's more than 2 months since the day they accepted our offer.

And today we should applied for another extension, but we called our broker, there is no respond. I called him and texted him, also called his office, no respond.

So my question is, the contract expired today, can we apply for the extension after we got in touch with our broker? It's that common that seller just don't respond to you and wait until the contract expired? I also learned that the escrow close agent also in vacation too.

I felt so frustrated, it takes forever and nobody follow up the case. What should I do now?

My first question would be, if you knew it was going to expire today, did you try to contact your agent 2 days ago?

My other comment would be - you're dealing with a government agency - anything goes!

You need to readjust your expectations. You have to stay on these people and constantly follow up. Do not expect anyone to do their job. Do not expect prompt responses. Do expect to make repeated calls and send repeated emails. Prepare to be ignored and treated as if you are an inconvenience. And pray you don't have to use the same title company that we did. If so, you have a long way to go until you close.

I just went through this. Never again.

We tried to contact our agent 2 days before the contract expired. But he didn't respond to us. So end up we go to the office and the other agent helped us applied for another extension 1 day after the contract expired.

My question is who should I contact if I want it speed up?

It has been 90 days. They promised us it will closed within 45 days. But they didn't.

In short... the idea is to put yourself back into the drivers seat.

Rather than accept their delays and all that...
show them that you're willing to take your very real offer off the table.

Let them try and find someone else who will pay that much...
because **you** no longer will.

The next step, and only assuming that you still really want the property, is to start the process over with a new LOWER offer.

But if the owner said you already made an offer with X amount, and now you make another offer with a lower number, so they think you want to back out, then they accept the other offer (maybe less or maybe the same like yours) while you still want the property?

I still don't get it

HUD can be quite the stickler when it comes to deadlines, typos, paperwork, etc... If you're not getting the service you need from your agent, I'd suggest you talk to the broker (provided you're still under contract with HUD and have signed a buyers agency agreement).

If you're out of the running because of extension delays (or whatever) and you still want the house and it's available, talk with the broker (if you're in an agreement). If you're not in a buyers agency agreement, then you should shop and find one that will respond promptly, is familiar with working with HUD, and take another try at it.
