As a seller, I have an agent for the contracted 6 months with no sale. I now have the option with going with a different agent or even going FSBO. My agent informs me that he will give me a list of previous showings to reference to for future showings. The time frame for his due diligence to any commission is 6 months. Who is responsible for monitoring this for that time span. Any agents out there come across this scenario. This also includes any family members of previous showings being ineligable for purchase without me paying commission to my previous agent.
He can't just give you the name of the agent that showed the listing, he needs to give you the names of the buyers that attended the showing. Most agents cannot produce such a list. It is the specific buyer, not the buyer agent, that is the source of procuring cause for the listing agent. You could have the same buyer agent show a completely different buyer your home with a new listing agent.
And for the record it is the listing agent's job to monitor it.
Thanks for the feedback. I still can see some "gray areas" here especially with the family member scenario. Based on the prospective buyer no disclosing to seller a direct relationship as a family member to previous showing but having a different last name. Any legal forms out there that could be signed in the process so seller doesn't get hit with a claim?
