I have a farm in Portland, OR area. It is zoned EFU, Exclusive Farm Use. I was running a horse boarding business. There are two residences on the property. I wanted farm help to live in one unit and I was told in order to have a secondary residence occupied I must make $80K gross farm income. I did not make $80K income. I was told my other option was to have a family member live in the other house to help with the farm.

I am selling the farm because, no family member wants to live here. I have also closed down my horse boarding business.

The house is for sale for $900K, a prospect calls the County and says they can't have their mother live in the second unit.

Prospect is scared off. I call the County and the woman that gave false information to the prospect agrees w/ me, that yes with the right permit the prospect's mother could occupy the second unit.

Prospect is gone. How do I keep this from happening again in the future?

You can't fix stupid, and the government can be very stupid at times. I encourage you to offer as much information as you can in the listing package from the county that may contradict a possible incorrect answer they provide to a prospective buyer. A little proactive work on your part can prevent a future "oops" from the county.

Thank you dontaskywhy. Can I put that in the MLS description? "Contact seller for dual residence information", or how would you word that?

I would go to the county planning office and make a copy of the applicable ordinances.

The county has our square footage wrong and getting that fixed has been about impossible. They claim we have more sf than we do, though, so in terms of what the listing says, we're on the "right side" of being wrong - we're not claiming more sf than the county thinks we have. We think they included the daylight basement garage area in the house's sf.

That's exactly the correct answer. The OP could place the information in the property disclosure file and could be easily accessed by or given to a potential buyer upon request.

If I were to word it, I would say, "additional information available upon request" in the realtor comments section. I realize that MLS verbiage can differ from market to market.

No point in offering too much information that isn't specifically requested. In my experience, questions about dual residence are few and far in between.

So I made an anonymous call to the County today and got the same false information, and then I called the girl on it. I asked the gal who was her boss's boss and put a call into him.

Believe it or not, the guy said he will put out an email to his employees at the desk that answer these questions. The memo is suppose to state the property is for sale and there can be additional relative housing based on going trough an application process.

I will believe it when I see it.

Anyway, it didn't hurt to mention his guy below him was taking bribes...got the main guy's blood pressure up.
