My question involves bankruptcy in the state of: New Jersey
Hello,
We filed for BK7 and discharged a year ago. Been paying our non-reaffirmed mortgage and we current ("Pay to Stay"). Also been paying the Property Taxes and Insurance...no bank escrow, I make the payments myself.
Unfortunately we now need to walk away from this house, so I have stopped making payments (only a month behind). The house is upside-down by 60K. We plan on living in the house until it is eventually foreclosed, I am doing this to save some money to move. My taxes are due May 1st, my question is...do I need to pay the taxes or will the bank pay them? From what I am reading, the last thing the bank wants is a tax sale on the property. Do I have to let the bank know that I will not be paying the taxes?
Contact your bankruptcy attorney. There may be something in your bankruptcy. You'll need an attorney for this mess anyway.
