Do you somehow think it's problematic that they were longtime tenants at another place? Obviously, if they stayed for 4 years, then their likely weren't problems with smoke in their particular unit.

Exactly, My guess is they decided to stay because they couldnt afford the "penalties" you were going to subject them to, not because it got better. Be ready for them to be spiteful for the next year. I think you are going to have a horrible 12 months as a landlord.

Also, while you cannot ask them to leave, you can say something like "As the landlord I will live up to the lease, but I will let you know that if you request to break the lease I will work with you and not penalize you beyond keeping the security." This way they have an out and you technically didn't ask to break the lease. You put them in this position of having to stay due to the financial hardship you've already admitted you would put them in. There's this thing called being civil and just cause the law states you can act a certain way doesn't mean you have to be that way. You chose to be a hard a**. That's your right, but be prepared cause if it were me I'd be the worst tenant in the world for the next year.

I never got the opportunity to explain any penalties.

I have a feeling these people sue or try to sue a lot of people. They are like roaches who don't like the light of reality. That's why they cancelled your meeting today. Light would be shined on what they prefer to do.

Be careful of anything they could film or record and doctor so as to say you are prejudiced against any of the protected classes they may belong to or may pretend they belong to and then have grounds to sue you. Keep notes and records, pix, whatever yourself.

I feel the same way. If they are so concerned about the smoking, come to the meeting and let the attorneys talk and come to a middle ground. But they did not even try. It was just threats from the start.

How about first sealing up your unit so it doesn't fill up with cigarette smoke? How old is this building? Older buildings tend to have lots of defects and small cracks throughout. It is because of situations like yours where it makes me leery of buying a condo unit and becoming a landlord. It could cause a ton of headache.

Legal fees, lawsuits, counter suits . . . that will quickly exceed any losses you might encounter getting rid of this guy and getting another tenant in place.

Plus, the stress alone isn't worth it. He's a loon, and if he's this miserable NOW, he's only going to get worse.
