It sounds like there is an agreed upon easement for the road and gate. A road maintenance agreement is not the same thing as an HOA. Now, if there is no ingress/egress, you folks have a definite issue if there is no other access to your homes other than that road. That would make those homes landlocked and a perfect example of why title insurance is so very important.

That would be my guess as well. I think that when they installed the gate and the city became aware of it, it really gave them two choices. Form an HOA and start maintaining the streets and other city property at their own expense or remove the gate. By installing the gate, the homeowners essentially took control of city property without any authority to do so.
