Does anyone know the work contact (email or phone) of any Lennar upper management covering North Carolina? I entered a purchase agreement with Lennar but due to unsatisfactory inspection I would like to back out of the agreement. The sales manager is not willing to return my earnest money for no reason. I understand this should probably be brought to a real estate attorney, but I'd like to know if it will raise some attention in its upper management first. Or maybe it's just my wishful thinking. Thanks much.

I worked for many years with a sub-contractor for Lennar. Even though my experience was not in NC I am willing to bet that notifying someone in upper management will accomplish nothing. Let your attorney get their attention. If the house fails inspection do not close on it.

Did you use the 49 page proprietary builder contract Lennar uses?

Does it offer you an inspection contingency?

My RE told me Lennar uses its own builder contract. It doesn't offer any inspection contingency as the sales agent told us Lennar would repair any issues found during the inspection. The problem is I don't feel comfortable buying this house anymore. There was a leaking issue before I signed the contract and Lennar issued a statement that it has been fixed. Then during the inspection another leaking was found in a different spot. I am losing faith in its build quality. How come a new construction has so many leaking problems.

You should consult with your agent on this, and should probably consult an attorney on the contract provisions regarding inspection and termination.
