I'm not real sure, but I think it would be assault and battery.
Making the threat is assault.
Actually hitting the person is battery.

At the very least, they would charge you with disorderly conduct which is a catch all used to diffuse the situation.... enough to make it a real hassle to deal with. Simply mouthing off in the presence of the officer is enough for that...

There is always a way out of this sticky situation.
A simple, "Hey? Look, I bought a pie...would you like to try some?" Then of course on the way over to her you trip 'accidentally' and WHAM!! It was an accident.
No judge can deny that it was an 'accident.' Lol!!
Why do I feel like OP now invites every single first date to Village Inn just in case they decide to stand them up and show up with someone else at the exact same restaurant?
Suppose a woman stands you up for a date. You go out to eat and she shows up...with another date.
At a restaurant that also happens to be a bakery.
Feeling jilted and resentful at being lied to, go up and purchase a chocolate cream pie. And walk over and smash it in her face the way they used to do in 20's era movies and walk out.
Can that be considered assault?
yes, it is called assault and battery, and it is a stupid way to get revenge on someone. while it might make you feel good for a moment in time, you lose so much more than just a date and in the end it isnt worth the effort.
What kind and what charges you may get under that banner will depend on what state you are in and if the person you "pie" chooses to go forward on them.

Someone else besides me had to be thinking this was regarding something else entirely when they clicked on this thread, right?
RIGHT?
I thought it was going to be something out of Urban Dictionary.
