Hi there,

My understanding is if no early termination clause in the original contract, than you are not suppose to early terminate. If you do, then you are reliable for all the rent till the end of the term.

But if a renter did not pay rent, and evicted by the landlord, then it is landlord terminated the contract. Renter only lose security deposit, but not own landlord any future rent till the end of the lease term. That will be a smarter way to early terminate the contract.

Do I understand it right? if so, how to prevent this kind of thing happen, how to write the contract non-payment clause?

any ideas?

Are you a landlord asking how to evict tenants, but still force them to pay the balance of rent for the entire lease? if so, I don't think that's possible.

If you evict them, you have to accept that they will not continue to pay rent in the future. Back rent, sure! But not future rent.

I am just saying it is a smart way to early terminate the lease or not paying rent. And landlord is not protected.

It's bad for the tenant too. They have to move, which is usually not inexpensive. And it shows up on their credit report, which makes it hard to rent again. An eviction is bad news for everyone involved.

Rather than try to squeeze blood from a turnip, maybe you should focus on screening better, and try to get tenants you won't have to evict?

check your state laws. many states still hold an evicted tenant responsible for further rent until a new tenant is found.

a tenant who has an an early termination of the lease by getting evicted dosnt mean the tenant isnt still liable for breaching the lease early.

no matter how well you screen tenants eventually the trifecta from landlord hell gets you at some point. divorce,illness and job loss are never something you can screen for and result in more evictions than anything else..
