I have not rented in over 10 years and need your advice.

I found a property I really like going over to sign a lease and just want some feedback.

The unit is in good shape and has some maintenance items that need fixing. In the past, I took a verbal from another privately owned unit landlord/different complex and got burned, item was never fixed during entire time.

So this time I want either those items needing to be fixed in the lease, or I want my check post dated in case it isn't resolved on move in date.

I heard a rumor banks cash post dated checks anyway?

Constructive feedback appreciated.

What I would do in this case is write up an understanding between LL and tenant and signed by both noting the repairs which have to be made prior to move-in with the caveat that if such repairs aren't completed by such and such a date the lease agreement will be null and void and all monies (list them/amounts and for what) will be immediately returned.

If they balk at writing down the issues would you take it as a red flag and walk? People in some areas accept verbal agreements I don't.

I would take it as a red flag. As a LL there is nothing that I would agree to verbally that I wouldn't be willing to put on paper. If I don't agree with something I simply say so. And I don't say ill fix something just to get a tenant in to start paying.

I wouldn't rent it. But, if you are determined to see if the past repeats itself, all of the above advice is good.

The problem I see is that if they don't fix everything - and odds are they won't - now you have to collect the money from the check they cashed. Can you afford to take the gamble?
